VIDOPE – CREATOR TERMS OF SERVICE

By signing up as a Creator on ViDope, you agree to:

• the General Terms & Conditions
• this Creator Terms of Service
• the Privacy Policy
• the Content & Usage Policy

ViDope acts solely as a marketplace connecting you with Clients. You are an independent contractor, not an employee.

1. Relationship with ViDope

1.1. Independent Contractor: You are self-employed. You control your schedule, content, and creative decisions.

1.2. No Employment: You are not an employee, agent, or partner of ViDope. You are not entitled to benefits, insurance, or minimum wage.

1.3. Taxes: You are solely responsible for declaring income and paying taxes in your jurisdiction.

1.4. Creator Account Ownership

The Creator must only register and operate ViDope using channels and social media accounts that they legally own or control.

The Creator represents and warrants that:

• they are the lawful owner of the YouTube/Instagram/TikTok account(s) connected to ViDope, or
• they have full legal authorization to use the account for commercial and promotional purposes.

ViDope is not responsible for any misuse, impersonation, unauthorized access, or fraudulent registration of channels or accounts.

Any dispute regarding channel ownership is strictly between the Creator and the rightful account owner.

ViDope may suspend or terminate any Creator account upon suspicion of unauthorized channel use, without refund or payout.

2. Service Obligations

When you accept a Client request, you agree to:

• Deliver the Service exactly as described in the briefing.
• Include all mandatory disclosures (e.g., #ad, #sponsored) as required by law (FTC, local EU laws) and platform rules.
• Keep the content live for the agreed duration (default: permanent or 30 days minimum).
• Maintain professional communication with the Client.

Failure to deliver may result in chargebacks (Token deductions) or account suspension.

3. Content & Safety Standards

You must NOT post content that includes:

• Hate speech, violence, or illegal acts.
• Nudity, sexual content, or pornography.
• Fraudulent schemes or misleading claims.
• Copyright infringement.

Violations will result in immediate ban and forfeiture of pending earnings.

4. Payments & Payouts

4.1. Earnings: You earn Tokens for completed Services.

4.2. Payouts: You may convert Tokens to cash via Stripe.

4.3. Platform Fee: ViDope deducts a service fee from each transaction.

4.4. Thresholds: Minimum payout amounts implementation may apply.

4.5. Disputes: If a Client reports non-delivery, payments may be held until resolved.

5. Intellectual Property Rights

5.1. You retain ownership of your channel and content.

5.2. You grant the Client a license to usage rights for the promotional segment as agreed in the order.

5.3. You grant ViDope the right to use your name, channel branding, and portfolio examples for marketing the Platform.

6. Account Termination

6.1. You may close your account at any time (after completing active orders).

6.2. ViDope may terminate your account for:

• Violation of these Terms.
• Low quality or non-delivery of services.
• Suspicious or fraudulent activity.

7. Liability & Indemnification

7.1. ViDope is not responsible for your content or how platforms (YouTube, etc.) treat it.

7.2. You agree to indemnify ViDope against any claims arising from your content or breach of these Terms.

8. Governing Law

These Creator Terms are governed by:

• the laws of the State of New Mexico
• the laws of the United States of America

Disputes are subject to the exclusive jurisdiction of the courts in New Mexico.
